1. Introduction
Welcome to 1 on 1 Phlebotomy. By using our drug testing services, you agree to comply with and be bound by the following terms and conditions. Please review them carefully. If you do not agree with these terms, you should not use our services.
2. Definitions
"Company," "we," "us," and "our" refer to 1 on 1 Phlebotomy.
"Client" refers to the individual or organization requesting drug testing services.
"Services" refers to the drug testing and related services provided by the Company.
3. Services Provided
Our services include but are not limited to:
Drug screening and testing
Random drug testing
Pre-employment drug testing
Post-accident drug testing
Return-to-duty drug testing
Follow-up testing
Phlebotomy (Blood draws)
4. Client Obligations
The Client agrees to:
Provide accurate and complete information for testing purposes.
Ensure that all individuals to be tested are aware of and consent to the testing.
Pay for all services rendered in accordance with the agreed pricing and payment terms.
5. Confidentiality
We are committed to protecting the confidentiality of all test results and related information. Test results will be disclosed only to authorized individuals as specified by the Client and as required by law.
6. Accuracy of Information
While we strive to provide accurate and reliable results, we do not warrant the accuracy, completeness, or reliability of any information provided. The Company shall not be liable for any errors or omissions in the results.
7. Payment Terms
All fees for services are due upon receipt of the invoice unless otherwise agreed in writing.
Late payments may incur interest at the rate of 3.5% per month.
The Client is responsible for all costs of collection, including reasonable attorney fees, in the event of non-payment.
8. Cancellations and Refunds
Services may be canceled by the Client with a 24-48 hour' notice. Cancellation fees may apply. Although client may cancel, funds can be transferred to a different appointment within 1 month, since there are no refunds. Appointment must be approved by 1 on 1 Phlebotomy.
Refunds are not available once a team member is enroute to your location and or testing has been completed, except in the case of errors attributable to the Company.
9. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to the use of our services.
10. Indemnification
The Client agrees to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses arising out of or related to the Client's use of our services.
11. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of Michigan. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Michigan.
12. Changes to Terms and Conditions
We reserve the right to modify these terms and conditions at any time.
